Terms and Conditions of Use

The official online store and distributor of the Lamberts brand in the Baltic States is owned by MPharma OÜ (registration code 14229338, Vabriku 3-8, Tallinn, 10411, Estonia).

General Terms and Conditions

These General Terms and Conditions apply to the legal relationship that arises when ordering food supplements (hereinafter referred to as “goods / food supplements”) through the ordering environment (hereinafter referred to as the “E-shop”) available on the official MPharma OÜ (hereinafter “MPharma”) website lambertsbaltic.com.

In addition to these General Terms and Conditions, the relationship between the Customer and MPharma is governed by the applicable laws of the Republic of Estonia, the price list of the E-shop, and established good practice.

1. General Terms of Ordering

1.1. The Customer does not need to register an account in the MPharma (Lamberts) e-shop to order food supplements.

1.2. The Customer selects the desired product(s), specifies the quantity, chooses a payment and delivery method, and confirms the order.

1.3. The price of the product does not include the shipping fee. The shipping fee depends on the method of delivery selected by the Customer.

1.4. Payment can be made via Internet bank (Estonia, Latvia, Lithuania, Finland), credit card, PayPal, Paysera, Montonio or another payment method provided on the site.

1.5. The order becomes valid once the payment has been received in MPharma’s bank account. MPharma will notify the Customer by email when the order is confirmed.

1.6. The Goods will be delivered according to the Customer’s chosen delivery method:

  • DPD Pickup
  • Itella SmartPOST parcel machine
  • Omniva parcel machine
  • Courier
  • Or any other method indicated in the ordering system

1.7. The delivery address can only be changed if the order has not yet left the warehouse. Additional fees may apply.

1.8. If the order has been placed and paid, it will be packed and dispatched on the next working day. If the order includes only food supplements available in the Estonian warehouse, delivery within Estonia will take 1–4 business days, within Latvia 1–5 days, and within Lithuania 1–6 days. In the case of a backorder, delivery may take up to 2 weeks. A notification will be sent via SMS and/or email with details on the parcel machine location, opening hours and a personal code. Parcels are stored for 7 calendar days free of charge. If not collected within this period, the parcel will be returned to the warehouse and reshipping fees will apply.

1.9. DHL, Omniva, Itella, DPD, Venipak, FedEx or another courier partner will deliver the goods to the address specified by the Customer within Estonia in 1–4 working days (1–5 days in Latvia and 1–6 days in Lithuania), provided that the products are available in the Estonian warehouse. In case of a backorder, delivery may take up to 2 weeks. If the courier cannot reach the Customer by phone, a delivery notice will be left in the mailbox and the parcel can be collected from the nearest post office. Parcels are stored for 7 calendar days before being returned and the order is cancelled.

1.10. All orders to countries not mentioned in clauses 1.8 and 1.9 are shipped worldwide based on the courier’s terms and estimated delivery times.

1.11. Automatic tracking of parcels after ordering is not available. To receive tracking information, send a request to order@lambertsbaltic.com.

1.12. MPharma assumes the Customer will receive the parcel personally. The courier has the right to deliver the parcel to another person reasonably assumed to represent the Customer (e.g., a family member or receptionist).

1.13. The risk of damage or loss transfers to the Customer once the parcel is delivered, either by the courier, parcel machine, or post office.

1.14. MPharma is not liable for damage that occurred after the parcel has been delivered, nor for damage resulting from misuse or incorrect use of the supplements.

1.14.1. Cold-sensitive products
Certain products (including capsule and oil-based food supplements) are sensitive to low temperatures. In such cases, MPharma recommends choosing an indoor parcel machine or another delivery solution that prevents the products from being exposed to sub-zero temperatures.

If the Customer selects an outdoor parcel machine or any other delivery method that involves a risk of exposure to cold, they do so at their own risk. MPharma is not liable for any damage, changes in quality or other loss resulting from temperature fluctuations caused by the delivery conditions chosen by the Customer.

1.15. If a product is not in stock at the time of ordering, it can be pre-ordered with an estimated delivery time of up to 2 weeks.

1.16. If the order includes both in-stock and out-of-stock items, all items will be shipped together within up to 2 weeks unless agreed otherwise.

1.17. All product prices include 24% VAT (according to the current VAT rate in Estonia).

1.18. All delivery fees include 24% VAT.

1.19. In the event of a change in the VAT rate, prices and delivery charges will be adjusted accordingly.

 

2. Order Cancellation, Modification or Return

2.1. A handling fee of 3 EUR may apply if the Customer requests order cancellation, modification, exchange, or reshipping. Additional shipping fees may apply depending on the selected delivery method.

2.2. To request order changes, cancellation, exchange or return, please fill in the contact form available here: Modification and cancellation of an order.
Please include your order number and clear instructions.

2.3. If the order has already been packed and a confirmation has been sent, a 3 EUR handling fee will be deducted upon cancellation.

2.4. After submitting the form, our customer service will contact you and provide further instructions, including return details if applicable.

2.5. Returns can be made using the return code provided after your return request has been processed. The return code is sent via SMS and can be used with DPD, Omniva or Venipak. For Itella, the personal parcel machine door code acts as the return code.

 

3. Customer Account Registration

3.1. Customers may register at lambertsbaltic.com.

3.2. Registration requires providing full and correct information to ensure successful delivery and communication.

3.3. A confirmation email with activation instructions will be sent after registration.

3.4. After activation, Customers can log in and place orders.
Ordering is also possible without registration.

 

4. Customer Rights

4.1. The Customer has the right to purchase food supplements from the online store at the prices and under the terms set by MPharma.

4.2.The supplements delivered to the Customer must be correct, complete, and comply with the terms set by MPharma.

4.3. The Customer has the right to submit claims regarding the order or supplements within 14 calendar days from receiving the goods by completing the relevant form: Modification and cancellation of an order.

4.4. The Customer has the right to withdraw from the order from the moment of placing the order until 14 calendar days after receiving the goods.

4.5. In accordance with § 53(4)4 of the Law of Obligations Act, goods with opened packaging, used or damaged goods (including damaged packaging) are not eligible for return, unless the damage occurred during transport and was reported immediately upon receipt.

4.6. If the Customer withdraws from the contract (i.e. returns the goods), MPharma will refund the amount paid for the goods. Delivery-related costs (including shipping fees) are not refundable.

4.7. For international orders, shipping costs are non-refundable and will be deducted from the refund amount.

4.8. To return goods, the Customer must submit a withdrawal request by completing the relevant form: Modification and cancellation of an order.

The Customer must provide their name and bank account details for the refund. Cash refunds are not issued.

The Customer must return the unused and undamaged goods without delay, but no later than 14 calendar days after submitting the request.

MPharma will refund the amount paid for the goods (excluding shipping costs) within 14 calendar days from receiving the returned goods.

5. Customer Obligations

5.1. Customers must provide accurate and complete information for order fulfilment: full name, address, phone number and email.

5.2. If the recipient differs from the Customer, the recipient’s data must also be provided.

5.3. MPharma is not responsible for delivery issues caused by incorrect or incomplete information.

5.4. By placing an order, the Customer agrees to these Terms and Conditions and undertakes to follow them.

5.5. Before using the supplements, the Customer must read the product label, packaging and usage instructions provided on the website. For additional advice, contact: pharmacist@lambertsbaltic.com.

 

6. Rights of MPharma

6.1. If the Customer fails to fulfil the agreed conditions, MPharma does not guarantee the successful processing or delivery of the order.

6.2. If the Customer does not pay on time, MPharma may forward the Customer’s data to a payment default register.

 

7. Obligations of MPharma

7.1. MPharma undertakes to deliver correct and compliant products.

7.2. MPharma registers and responds to all Customer claims.

7.3. Complaints not caused by the Customer will be resolved within 7 working days. If the Customer is responsible, the issue must be corrected immediately by the Customer.

7.4. MPharma will replace defective products if defects are present upon delivery.

7.5. MPharma is not liable for delays or damages caused by circumstances beyond its control, including force majeure or technical issues in the online store.

 

8. Other Conditions

8.1. Product photos are illustrative. Differences in packaging do not entitle the Customer to return the goods, provided that the content, quantity and specifications match the order.

8.2. Product availability may change without prior notice. If the item is out of stock after purchase, MPharma will refund the Customer within 14 calendar days.

8.3. Disputes will be resolved by negotiation. If this fails, Customers may submit a complaint to the Consumer Disputes Committee (Estonia) or court. Complaints are free of charge.

8.5. All product descriptions, photos and other materials on lambertsbaltic.com are protected by copyright. Copying or use without MPharma’s written consent is prohibited.
